1. Introduction and Acceptance

These In-App Purchase Terms and Conditions ("Terms") govern all purchases of virtual items, virtual currency, subscriptions, and other digital content ("In-App Purchases") within Vilaayath Budha - The Sandalwood Survival ("the Game"), developed and published by Offline Human Studios ("we," "us," "our," or "the Developer").

By making any In-App Purchase, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our general Terms of Service. If you do not agree to these Terms, do not make any In-App Purchases.

 

2. Eligibility and Age Requirements

2.1 Age Restrictions
You must be at least 18 years of age to make In-App Purchases. If you are between 13 and 17 years of age, you may only make In-App Purchases with the involvement, supervision, and approval of a parent or legal guardian who agrees to be bound by these Terms.

2.2 Parental Responsibility
Parents and guardians are responsible for monitoring their children's use of the Game and any In-App Purchases made. We strongly recommend enabling parental controls and purchase authentication features available through your device settings, Google Play Store, or Apple App Store.

2.3 Regional Compliance
Users in India must comply with the Information Technology Act, 2000, and the Consumer Protection Act, 2019. Users in other jurisdictions must comply with their local laws regarding digital purchases.

 

3. Description of In-App Purchases

3.1 Virtual Currency
The Game may offer virtual currency, including but not limited to "Sandalwood Coins," "Kerala Gold," or similar denominations ("Virtual Currency"). Virtual Currency can be purchased with real money and used within the Game to acquire virtual items.

3.2 Virtual Items
The Game offers various virtual items available for purchase, including but not limited to:

• Character customization items (clothing, accessories, appearance modifications for Double Mohan)

• Vehicle skins and modifications

• Resort building materials and decorations

• Story episode unlocks and expansions

• Seasonal and limited-time content

• Convenience items and gameplay boosters

3.3 Subscriptions
The Game may offer subscription services providing recurring access to premium content, features, or benefits. Subscription terms, pricing, and renewal periods will be clearly disclosed at the point of purchase.

3.4 Episode and Story Content
Additional story chapters and episodic content may be offered as one-time purchases, providing permanent access to narrative expansions.

 

4. Purchase Process and Payment

4.1 Platform Processing
All In-App Purchases are processed through the Apple App Store (for iOS devices) or Google Play Store (for Android devices). By making a purchase, you agree to the respective platform's terms of service and payment processing terms:

4.2 Pricing
All prices are displayed in your local currency as determined by the respective platform. Prices include applicable taxes where required by law. We reserve the right to modify prices at any time, but changes will not affect purchases already completed.

4.3 Payment Authorization
You authorize the applicable platform (Apple or Google) to charge your selected payment method for all In-App Purchases. You are responsible for ensuring your payment information is accurate and that sufficient funds are available.

4.4 Purchase Confirmation
Upon successful completion of a purchase, you will receive a confirmation through the respective platform. Virtual items and currency will be credited to your game account promptly.

 

5. Nature of Virtual Items and Currency

5.1 License, Not Ownership
When you acquire Virtual Currency or Virtual Items, you receive a limited, non-exclusive, non-transferable, revocable license to use such items within the Game. You do not own Virtual Currency or Virtual Items; you purchase the right to use them subject to these Terms.

5.2 No Real-World Value
Virtual Currency and Virtual Items have no real-world monetary value and cannot be:

• Redeemed for real money, goods, or services

• Transferred, sold, or exchanged outside the Game

• Converted to any other form of currency or value

• Inherited or transferred upon account termination

5.3 No Gambling
The Game does not offer gambling or games of chance involving real money. Any randomized reward systems within the Game do not constitute gambling, and outcomes have no real-world monetary value.

 

6. Refund Policy

6.1 Platform Refund Policies
Refund requests for In-App Purchases must be directed to the platform through which the purchase was made:

For Apple App Store purchases:

For Google Play Store purchases:

6.2 Developer Assistance
While refunds are processed by the respective platforms, you may contact us at [support email] for assistance with purchase-related issues. We will cooperate with platform investigations as required.

6.3 Indian Consumer Rights
Users in India retain rights under the Consumer Protection Act, 2019, and the Consumer Protection (E-Commerce) Rules, 2020, including the right to seek redress for deficient services through appropriate consumer forums.

6.4 Cooling-Off Period
In jurisdictions where a statutory cooling-off period applies, you acknowledge that by making an In-App Purchase and immediately accessing the digital content, you may waive your right to cancel under applicable consumer protection laws, to the extent permitted by law.

 

7. Subscription Terms

7.1 Automatic Renewal
Subscriptions automatically renew at the end of each subscription period unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

7.2 Subscription Management
You may manage and cancel subscriptions through:

• iOS: Settings > [Your Name] > Subscriptions

• Android: Google Play Store > Menu > Subscriptions

7.3 Cancellation
Cancellation takes effect at the end of the current billing period. You will retain access to subscription benefits until the end of the paid period. No partial refunds are provided for unused portions of a subscription period.

7.4 Price Changes
We may change subscription prices. You will be notified in advance of any price changes, and your continued subscription after the price change takes effect constitutes acceptance of the new price.

 

8. Account and Purchase Security

8.1 Account Responsibility
You are responsible for maintaining the security of your account and device. Purchases made through your account or device are your responsibility.

8.2 Unauthorized Purchases
Report unauthorized purchases immediately to the relevant platform (Apple or Google) and to us at [support email]. We recommend enabling purchase authentication (password, biometric, or PIN) on your device.

8.3 Account Linking
In-App Purchases are linked to your game account. If you use multiple devices, purchases may be accessible across devices when logged into the same account, subject to platform limitations.

 

9. Modifications and Discontinuation

9.1 Game Modifications
We reserve the right to modify, update, or discontinue any aspect of the Game, including Virtual Items, Virtual Currency, and features, at any time. We will endeavor to provide reasonable notice of material changes.

9.2 Item Balancing
Virtual Items may be modified for game balancing purposes. Such modifications do not entitle you to a refund unless the item is fundamentally different from what was advertised at purchase.

9.3 Service Discontinuation
If we discontinue the Game entirely, we will provide at least 30 days' notice where practicable. Upon discontinuation, all licenses to Virtual Items and Virtual Currency terminate, and no refunds will be provided except as required by applicable law.

 

10. Prohibited Conduct

You agree not to:

• Purchase Virtual Currency or Items through unauthorized third parties

• Exploit bugs or glitches to obtain unpaid items

• Use automated systems or bots to make purchases

• Engage in fraudulent chargebacks or payment disputes

• Transfer, sell, or trade accounts or virtual items outside the Game

• Circumvent any purchase restrictions or security measures

Violation of these prohibitions may result in account suspension or termination without refund.

 

11. Intellectual Property

11.1 Ownership
The Game, including all Virtual Items, Virtual Currency, graphics, audio, and other content, is owned by Offline Human Studios or its licensors. The character Double Mohan is used under license from [Film Production Company Name].

11.2 Limited Use
Your license to use Virtual Items and Virtual Currency is limited to personal, non-commercial use within the Game.

 

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN-APP PURCHASES AND VIRTUAL ITEMS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that Virtual Items will be available indefinitely or that the Game will be error-free or uninterrupted.

 

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OFFLINE HUMAN STUDIOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO IN-APP PURCHASES, INCLUDING BUT NOT LIMITED TO LOSS OF VIRTUAL ITEMS, ACCOUNT DATA, OR GAME PROGRESS.

Our total liability for any claim arising from In-App Purchases shall not exceed the amount you paid for the specific purchase giving rise to the claim.

NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR FRAUD OR FRAUDULENT MISREPRESENTATION.

 

14. Governing Law and Dispute Resolution

14.1 Governing Law
These Terms are governed by the laws of India, without regard to conflict of law principles.

14.2 Dispute Resolution
Any dispute arising from these Terms or In-App Purchases shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts in Kerala, India.

14.3 Consumer Forums
Nothing in these Terms prevents you from filing complaints with consumer forums or regulatory authorities in your jurisdiction as permitted by applicable law.

 

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified through the Game or via email. Your continued use of In-App Purchase features after changes take effect constitutes acceptance of the revised Terms.

 

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

18. Platform-Specific Acknowledgments

18.1 Apple App Store
You acknowledge that these Terms are between you and Offline Human Studios, not Apple. Apple has no obligation to furnish maintenance or support services with respect to the Game or In-App Purchases.

18.2 Google Play Store
You acknowledge that Google is not responsible for addressing any claims relating to the Game or In-App Purchases, including product liability claims, consumer protection claims, or intellectual property infringement claims.

 

By making any In-App Purchase, you confirm that you have read, understood, and agree to these Terms and Conditions.
